FabFunnels Terms of Use

These Terms of Use (“Agreement”) govern your access to and use of FabFunnels, including all related software, content, tools, services, and features provided through the FabFunnels.ai platform (“FabFunnels,” “Platform,” “we,” “our,” or “us”). FabFunnels is built on the GoHighLevel platform and operated by Clear Consultants Pty Ltd in Queensland, Australia. 

By accessing or using FabFunnels, you agree to these Terms. If you do not agree, you must not use the Platform. 

Eligibility and Age of Access 

You must be at least 18 years of age to use FabFunnels. By registering, you represent and warrant that you are 18 years or older. 

Account Registration and Security 

To access FabFunnels, you must register for an account using accurate and complete information. 

You are solely responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. 

Sharing login credentials with others is strictly prohibited. Violation may result in suspension or termination of access without refund. 

You agree to notify us immediately of any unauthorized use of your account. 

Plans, Payments, and Renewals 

Pricing and plan options (monthly or annual) are displayed at the time of purchase. 

All subscriptions renew automatically unless cancelled before the renewal date. 

By purchasing a plan, you authorize us to charge your designated payment method for all applicable fees. 

Cancellations and Refunds 

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle. 

FabFunnels offers a 30-day money-back guarantee from the date of your initial purchase. 

After the 30-day period, all sales are final, and no refunds will be provided for any reason, including change of mind or circumstance. 

You agree not to initiate chargebacks after the 30-day refund period. Any chargeback attempts may result in account termination and reporting to relevant agencies. 

Acceptable Use and Code of Conduct 

You agree not to: - Use FabFunnels for any unlawful, abusive, fraudulent, or harmful activity. - Distribute viruses, malware, or harmful code. - Share Platform content, templates, or training with individuals who are not authorized users. - Host client funnels under your account unless explicitly permitted under your plan. - Engage in harassment, hate speech, or discriminatory behaviour toward our staff, contractors, or community. 

Violation of this section may result in termination of your account without refund. 

Intellectual Property 

All content, software, templates, and resources within FabFunnels remain the intellectual property of Clear Consultants Pty Ltd or its licensors. 

You are granted a limited, revocable, non-transferable license to use the Platform for your personal or business use as permitted under your subscription. 

You may not copy, resell, sublicense, reverse engineer, or redistribute any part of the Platform without written consent. 

Content you upload (“User Content”) remains your property. You grant us a license to host, store, and use such content as necessary to operate the Platform. 

Third-Party Services 

FabFunnels integrates with third-party providers such as GoHighLevel and payment processors. We are not responsible for the performance, policies, or terms of third-party services. 

Disclaimers and Limitation of Liability 

FabFunnels is provided “as is” and “as available.” We make no guarantees that the Platform will be error-free, uninterrupted, or produce specific results. 

To the maximum extent permitted by law, our liability for any claim relating to your use of FabFunnels is limited to the amount paid by you in the 12 months preceding the claim. 

We are not liable for indirect, incidental, special, or consequential damages. 

Indemnification 

You agree to indemnify and hold harmless Clear Consultants Pty Ltd, its directors, employees, contractors, and affiliates against any claims, liabilities, damages, or expenses arising from: - Your use of the Platform; - Your violation of these Terms; or - Your infringement of third-party rights. 

Data Protection and Privacy 

You must comply with all applicable data protection and privacy laws, including but not limited to the Australian Privacy Act 1988, GDPR (if applicable), and CAN-SPAM. 

You are responsible for obtaining all necessary consents and providing required disclosures when collecting and processing personal data through FabFunnels. 

FabFunnels’ use of personal data is governed by our Privacy Policy. 

Force Majeure 

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, pandemics, power or internet outages, or changes to third-party platform policies. 

Intellectual Property Claims (Copyright & Trademark) 

If you believe your intellectual property rights have been infringed within FabFunnels, please notify us in writing with full details. We will investigate and take appropriate action, which may include removal of content or suspension of accounts. 

Governing Law and Disputes 

This Agreement is governed by the laws of Queensland, Australia. Any disputes will be resolved exclusively in the courts of Queensland. Both parties waive the right to trial by jury and agree that disputes will be resolved on an individual basis. 

Modifications 

We reserve the right to update or amend these Terms at any time. Changes are effective immediately upon posting. Continued use of FabFunnels indicates acceptance of the revised Terms. 

Diversity, Equity, and Inclusion 

We are committed to providing a safe and inclusive environment. Discrimination, harassment, or hate speech of any kind is not tolerated and may result in immediate termination of access without refund. 

Entire Agreement 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Clear Consultants Pty Ltd regarding FabFunnels and supersede all prior agreements.
